India once again emphasised on making Trade related intellectual property rights (TRIPS) of the WTO norms more flexible.
Prime minister of India Narendra Modi addressed the second Digital convention based on corona virus hoasted by the US president Joe Biden. In this forum India again underlined the importance of waiver in the TRIPS norms of the WTO so that it can give an opportunity to the developing nations to get the technology and make the vaccine.
WTO came in 1994 and the very next year TRIPS was introduced. It has some provisions to amend in the norms and make the patent rights more flexible. Patent is an exclusive rights over any ideas or things and no country can make the things without prior permission from the right holder. India in this conference tries to highlight the importance of waiver as a need of time because the corona virus has engulfed the world and the world is facing huge loss of lives everywhere.
On the basis of humanity India, srilanka and South Africa has stood boldly against the hard norms of TRIPS. Since a decision is taken by referendum, it is failed if any members discards the proposal. And the same has been seen over the issue.
India has basic facilities to produce the vaccine once it gets the patent and India did it well, even India has delved it's own indigenous vaccine made by BHARAT Biotech called covaxin. But the problem is not ending here. Here the opportunity is not the same with every country. There are many countries in the world which doesn't have even a single patent idea and infrastructure about it. So the main country has to keeping hands all the time to the donar country. Here it is the big limitations of the developing nations.
Compulsory licensensing, focused by European union, is another kind of methods well applied earlier and succeeded in the case of AIDS. But this time, it is the case of pandemic and no country in the world is away from the loss of corona pandemic.
The world must negotiate over the issue and take it seriously because it affects humankind and humanity is in danger. So the combined collaboration with the developed world could yield better results and have helpful to the developing nations.
